TERMS & BOOKING CONDITIONS

GENERALLY

We feel sure that you will have an enjoyable stay in our apartment and hope you will treat it as you would your own home but trust you will appreciate that certain conditions have to apply as shown below.

BOOKING

The signing of a booking form confirms acceptance of the terms and conditions and shall be binding on all persons intending to occupy the property.  A booking can only be confirmed when we receive the booking form and deposit.  Provisional bookings will be held for up to 7 days to allow time for the deposit to arrive.  The form must be completed by a party member who is at least 25 years of age.  This person will then be deemed as the primary contact for all persons shown on the form.  After receipt of the booking form and deposit we will decline all further enquiries for the relevant dates required.  We reserve the right to decline any group.

DEPOSIT

A deposit of $200 per week is required to secure the booking.

BALANCE

The balance is due no later than 8 weeks prior to arrival at the apartment.  If payment of the balance is not received by that date, the booking is deemed cancelled and any deposit paid becomes non-refundable.

SECURITY DEPOSIT

A refundable security/damage deposit of $250 is required to be paid with the final balance.  This will be refunded in full within 7 days of departure unless damage or loss is found during the inspection following your visit, extra cleaning is required, or if there is excessive/unreasonable use of electricity.  NB  Leaving doors/windows open whilst the air conditioning is operating will result in very high use of electricity and may cause breakdown of the equipment for which you may be deemed liable. 

CANCELLATION

In the event of you cancelling the reservation the following charges will apply.

Refund of 100% due if cancelled 59 days prior to check in date

Refund of 50% due if cancelled 29 days prior to check in date

Refund of 0% due if cancelled 14 days prior to check in date

Confirmation of cancellation must be received in writing.

INSURANCE

Please ensure you have adequate insurance to cover delays, cancellation, medical treatment and loss of luggage and personal effects.  Our insurance covers our home but does not cover any loss or damage to your personal items.

AMENDMENTS

Alterations to confirmed bookings can usually be accepted at the owners' discretion.  Please confirm changes in writing, a new booking form may need to be completed.

ACCOMMODATION

Occupancy is limited to a maximum of 6 people.  Only the persons named on the booking form are allowed to stay in the property, we are required by Florida Statute to keep an accurate record of all guests.  Deliberate abuse of the booking conditions, illegal activities or misuse of the home may result in the party being evicted.

CHECK IN/CHECK OUT

Access to the apartment is after 1600 hours on the day of arrival and guests are required to vacate the property by 1000 hours on the day of departure to allow time for cleaning before the next guests arrive.  In the event of a late departure there will be a fee chargeable of $50 unless a prior arrangement has been made.

SAFETY

Guests are responsible for their own safety and that of young children and frail elderly persons, especially in the communal pool and surrounding area.  Particular attention is drawn to the rules of the pool area as displayed, and Minors must be accompanied by a responsible Adult when visiting the Community Pool and Games Room/Cinema.  Please take care on the non-carpeted areas inside our home as these can become slippery when wet.

SMOKING

Smoking inside the property including the balcony area is strictly prohibited.

INSECTS

Florida is semi-tropical and insects are a fact of life.  Keeping doors and windows closed especially in the summer months will keep out unwanted creatures.  The balcony is enclosed by an insect net and it is always wise to avoid leaving any food debris around to discourage pests.

PETS/ANIMALS

No pets or animals are allowed in the property under any circumstance.

LIABILITY LIMITATIONS

The owners or owners' agents are not liable for any loss or damage to personal effects or personal accidents, injury, illness or death. 

The owners or owners' agent cannot be held responsible for, or be liable in respect of loss, damage or changes caused by Force Majeure (eg. strikes, floods, closure of airports, weather conditions, pandemic or other events beyond our control).

The owners cannot accept any liability for failure of public services/utilities such as water, electricity, telephone/internet service or cable TV service, nor do we accept liability for the consequences of the actions or omissions of others that may supply or control main services, or any actions taken in the vicinity of the property by any authority over which there is no control.  In the unlikely event of us being negligent and/or in breach of our contract with you, our liability shall be limited to the cost of your booking with us.

There may be occasions when maintenance needs to be carried out to Resort facilities resulting in temporary loss of use and whilst we will always endeavour to notify Guests of any programmed work, we cannot be held responsible for any unavailability.

PROBLEMS

In the unlikely event that any damage to the property is found on arrival it should be reported to our management company within the first 24 hours of arrival and they will do their best to assist and rectify any matter as soon as possible.  Failure to do so will invalidate any complaint and the homeowners will not enter into any correspondence for any circumstances not brought to the attention of management within this time span.  Should any problems arise during your stay our local management company is on hand to help.
